The BPAs and the BOAs are very similar in that they are basic agreements concluded as soon as the government has identified elements that are used on a repetitive basis. However, they differ in their use because the ATPs apply to the expected requirements and use the terms of the GSA calendar contracts (or other contracts) of the suppliers. BOAs are used when future needs are indeterminate. These agreements contain their own terms and conditions. Neither the BOAs nor the BPAs are considered binding contracts until contracts are made against them. These markets become binding contracts.
